Welcome to Agobid, a live-streaming marketplace that supports small and medium-sized businesses and individuals in selling their products online. By using Agobid, you agree to these Terms and Conditions, as well as our Privacy Policy. Please read carefully before accessing the platform.
1. Acceptance of Terms
By using Agobid, you agree to be bound by these Terms. If you do not agree, you must cease using the app immediately. Agobid reserves the right to change or modify these Terms at any time, and your continued use signifies acceptance of those modifications. Notifications will be posted in the app and website.
2. Eligibility and Account Responsibility
Users must be at least 18 years old or have the legal capacity to enter into binding agreements in their country. Users are responsible for providing accurate information when creating an account. Agobid may terminate any account found to have falsified information.
- Account Security: You are responsible for maintaining the confidentiality of your login credentials. Any activity carried out under your account is your responsibility, and Agobid shall not be liable for any unauthorized use.
3. Services Provided
Agobid allows users to livestream and sell products directly to an audience. The platform serves as a facilitator between buyers and sellers, but is not responsible for the products listed or sold through the platform.
- Sales and Transactions: Agobid does not own or control the products sold. All sales agreements are between buyers and sellers. Agobid is not responsible for product quality, shipping, refunds, or compliance with local laws.
- Streaming Guidelines: Livestreams must comply with our community guidelines, which prohibit any harmful, offensive, illegal, or misleading content.
4. Content Ownership and Licenses
Users retain ownership of any content they post or stream via Agobid. By streaming or uploading content, you grant Agobid a worldwide, non-exclusive, royalty-free license to use, distribute, reproduce, and display such content for promotional or operational purposes.
- Third-party Content: Users must ensure that their content does not infringe on the intellectual property rights of others. This includes music, video, images, or text used during live streams.
- Content Moderation: Agobid reserves the right to remove content that violates these Terms or any applicable laws. We may also suspend or terminate user accounts for serious or repeated violations.
5. Prohibited Conduct
To maintain a safe and positive environment for all users, the following activities are strictly prohibited:
- Illegal or Fraudulent Activities: Selling counterfeit goods, illegal products, or engaging in fraudulent transactions.
- Harmful Content: Livestreaming content that promotes violence, hate speech, pornography, or any inappropriate material.
- Misleading Advertising: Selling products under false pretenses or making exaggerated claims about their quality or availability.
- Violation of Third-party Rights: Including copyrighted materials without permission.
Violations of these prohibitions may lead to suspension or termination of accounts, as well as legal action.
6. Fees, Payments, and Transactions
Sellers on Agobid may be subject to transaction fees. These fees will be clearly stated during the setup process.
- Payment Gateway: All financial transactions are processed through third-party payment providers, and Agobid is not responsible for any delays, errors, or disputes regarding payment.
- Refunds: Any requests for refunds should be handled between the buyer and seller. Agobid will not be responsible for mediating or resolving disputes.
7. Termination of Account and Suspension of Services
Agobid reserves the right to suspend or terminate user accounts without prior notice for violating any of these Terms or if the account is found to be engaged in activities that harm the platform or other users.
- Voluntary Termination: Users may request the closure of their accounts by contacting agobid@agogoo.africa.
8. Compliance with App Store Policies
For users on Apple’s App Store and Google Play Store, Agobid complies with all relevant policies, including those concerning in-app purchases, data protection, and user privacy. Any violations of these policies may lead to removal of the app from these platforms.
- In-app Purchases: If applicable, users can make in-app purchases, and these will be subject to the policies of Apple or Google.
- Data Security: We prioritize the security of your personal information and adhere to strict data protection regulations.
9. Disclaimer of Warranties
Agobid provides its services “as-is” and “as available.” We do not guarantee that the platform will be uninterrupted, error-free, or secure. Agobid does not provide warranties for the products sold on the platform.
- Technical Issues: While we strive for the platform to function seamlessly, you acknowledge that there may be technical delays or errors. Agobid will not be responsible for any losses arising from service disruptions.
10. Limitation of Liability
In no event shall Agobid, its affiliates, employees, or agents be liable for any indirect, incidental, or consequential damages arising out of your use of the platform, including but not limited to the loss of profits, data, or business.
- Maximum Liability: Our maximum liability to you under these Terms will not exceed the total amount you have paid to us in the last 6 months, or $100, whichever is lower.
11. Indemnification
You agree to indemnify and hold Agobid, its officers, employees, and partners harmless from any claims, liabilities, damages, and expenses arising out of your use of the platform, your violation of these Terms, or any infringement on the rights of a third party.
12. Dispute Resolution
If any disputes arise between you and Agobid regarding the use of the platform, both parties agree to first attempt an amicable resolution by contacting agobid@agogoo.africa. If the dispute cannot be resolved, it will be settled through arbitration in the jurisdiction of [Location], under the laws of [Governing Jurisdiction].
13. Changes to the Terms
Agobid may modify or update these Terms at any time. All changes will be communicated to users either via email or through notices in the app. Continued use of the platform after such modifications implies acceptance of the revised Terms.
